Acceptable Use

This Acceptable Use Policy (the "AUP") governs how you may use Autopage, a service operated by Finalform GmbH, Theodor-Heuss-Str. 106, 26129 Oldenburg, Germany, registered with the Amtsgericht Oldenburg under HRB 222780, VAT identification number DE457693089, represented by its managing director Robin Schröder ("Finalform", "we", "us"). Capitalized terms not defined here have the meaning given in the Terms of Service.

1. Scope and Incorporation

This AUP is part of, and is incorporated by reference into, the Autopage Terms of Service in the version dated 2026-09-23. It applies to all use of Autopage, including the dashboard, the API, and the JavaScript snippet you install on your pages (the "Snippet"). If you do not accept this AUP, you may not use Autopage. Where this AUP conflicts with the Terms of Service, the Terms of Service control unless the Terms expressly state otherwise.

A breach of this AUP is a breach of the Terms of Service. We may update this AUP from time to time in accordance with Section 9; the version that applies to you is the version in force when you use Autopage, and material updates require your renewed acceptance.

2. Eligibility

Autopage is a business-to-business (B2B) service. You may use it only in the course of a trade, business, craft, or profession (as an Unternehmer within the meaning of Section 14 BGB), and not as a consumer. By using Autopage you confirm that you are acting on behalf of a business and are authorized to bind that business.

You may connect to Autopage only pages, domains, and properties that you own or otherwise control and are authorized to modify. You may not install the Snippet on, or run experiments against, any page you do not own or control.

3. Prohibited Content and Uses

You may not use Autopage, and you may not allow Autopage to operate on pages, in connection with any of the following:

1. Content or activity that is unlawful, or that infringes any law or regulation applicable to you or your visitors.
2. Content that infringes the intellectual property rights of any third party, including copyright, trademark, design, or trade secret rights.
3. Content that is deceptive, misleading, or constitutes false advertising, or that makes claims you cannot substantiate.
4. Malware, malicious code, exploits, or any code or content designed to harm, disrupt, or gain unauthorized access to systems or data.
5. Content that violates the privacy or data protection rights of any third party.
6. Pages, domains, or properties that you do not own or control, or that you are not authorized to modify.

3.1 Prohibited safety categories

You may not use Autopage, in any jurisdiction, in connection with any of the following, which are prohibited without exception:

1. Child sexual abuse material, or any content that sexualizes minors or facilitates their exploitation.
2. Content that promotes or incites hatred, harassment, or violence against a person or group on the basis of a protected trait, including race, ethnic origin, nationality, religion, disability, age, sex, sexual orientation, or gender identity.
3. Content that supports, promotes, finances, or glorifies terrorism or violent extremism.
4. Content that promotes, encourages, or provides instructions for self-harm, suicide, or eating disorders.
5. Content that depicts or promotes extreme or gratuitous violence.

3.2 Restricted and regulated industries

The following uses are not banned outright, but are permitted only where you are licensed, authorized, and fully compliant with the laws and advertising rules of every jurisdiction in which the relevant pages are published. You are solely responsible for that compliance.

1. Cryptocurrency, digital-asset, and other financial promotions or investment solicitations.
2. Pharmaceuticals, supplements, medical devices, and health or therapeutic claims.
3. Gambling, betting, lotteries, and games of chance.
4. Adult content and adult services.
5. Multi-level marketing, network marketing, and similar referral-chain schemes.

You are solely responsible for the content on your pages, including any content as modified or served by Autopage.

4. AI-Specific Use Rules

Autopage generates page variants and rewrites live copy using AI, specifically a large language model supplied by Anthropic, PBC. The model receives only your business brief, the baseline copy of your own pages, and population-level performance metrics; no per-visitor data is sent to it. The following rules apply to that AI functionality:

1. You may not use Autopage's AI variants to generate, serve, or publish advertising claims or other content that is illegal, false, misleading, or otherwise non-compliant with the laws and advertising rules that apply to you, including the German Act against Unfair Competition (UWG). You must be able to substantiate any factual advertising claim contained in an AI-generated variant before it is served, to the same standard that would apply if you had written it yourself.
2. You remain the publisher of all content served on your pages, including AI-generated variants. You are responsible for the truthfulness, legality, and intellectual property clearance of that content.
3. AI variants are probabilistic suggestions, not guaranteed-compliant copy. Where you have a reasonable opportunity to review an AI-generated change before it is served, you must review it. You must monitor variants while they are served in every case, and you must stop or roll back any variant that is inaccurate, non-compliant, or otherwise unsuitable.

The publisher-responsibility and review obligations in this Section are intended to be consistent with the AI-output allocation in Section 6 of the Terms of Service; the two are to be read together and do not displace one another.

5. Technical Abuse

You may not, and may not permit any third party to:

1. Attempt to disrupt, degrade, overload, or interfere with Autopage or the infrastructure that runs it, including by any denial-of-service or distributed-denial-of-service activity.
2. Probe, scan, or test the vulnerability of the service, or breach or circumvent any security or authentication measure, except under a written authorization from us.
3. Reverse engineer, decompile, or disassemble any part of the service, except as permitted by Section 9 of the Terms of Service, which names the statutory rights that cannot be excluded and the way we ask you to exercise the error-correction right.
4. Circumvent or attempt to circumvent plan limits, usage quotas, billing controls, or the consent gating described in Section 6.
5. Access the service by automated means, including robots, spiders, scrapers, crawlers, or offline readers, except through the documented API and in accordance with the Terms of Service. The documented API is the only permitted route for automated access.
6. Generate request volumes, whether through the documented API or otherwise, that materially exceed a reasonable rate of use, or that are designed to extract bulk data or to evade the service's rate controls. We operate rate limits to protect the service and may adjust them; you must not design around them.

We describe these limits qualitatively rather than by fixed figures, and reasonable use is judged in the context of normal operation of the service.

6. Consent and Visitor Data

The Snippet can read and write information on a visitor's device and collect behavioral data. Under Section 25 TDDDG (the Telekommunikation-Digitale-Dienste-Datenschutz-Gesetz, which replaced the TTDSG on 2024-05-14) and applicable data protection law, this generally requires the visitor's prior consent.

You must:

1. Obtain valid Section 25 TDDDG consent from your visitors before any non-essential information is stored on or read from their device and before any behavioral data is collected.
2. Configure your consent management platform so that Autopage is gated and runs on a default-deny basis, firing only after a valid consent signal is present, and registered under a Statistics, Analytics, or Personalization category, never as Necessary or Essential.

These duties sit with you as controller. They are described further in the Data Processing Agreement, and our support team can provide consent-gating integration guidance on request.

If you do not configure a consent management platform, Autopage does not stop. On a page where the Snippet recognizes no consent mechanism, it starts measuring three seconds into the visit. This is a fallback, not consent: it is never recorded as consent, and it relies on your own lawful basis as controller rather than on anything the visitor did.

Recognition is pattern-based, and the limit matters to you. The Snippet recognizes the IAB TCF API, the common banner vendors by their scripts, globals and containers, and Google Consent Mode. A recognized mechanism is always waited for, including one that never answers and one the Snippet cannot read the outcome of. A fully custom banner that matches none of those patterns is not recognized, and the fallback still applies to it. If you run one, wire it to window.autopage.grantConsent() so the Snippet waits for it, or switch the fallback off. No page in strict mode is measured this way in any case. You can switch the fallback off at any time in your dashboard under Settings, then Install snippet.

Who is responsible for the measurement on your pages. As controller and as operator of your pages, you are responsible for the lawfulness of how measurement is configured on them. That covers your choice, for each page, between strict mode and the default mode with the fallback described above; how your consent banner is wired, including the call to window.autopage.grantConsent() where the Snippet does not recognize your banner; and the Section 25 TDDDG consent itself.

We are responsible for the Snippet behaving as this Section describes it: the recognition of consent mechanisms, the three-second fallback, strict mode, and the switch in your dashboard settings that turns the fallback off.

Where your configuration does not meet your duties under items 1 and 2 of this Section, the consequences stay with you to the extent the Snippet behaved as described. Where the Snippet did not behave as described, this allocation does not apply and Section 10 of the Terms of Service governs.

Any cost this allocation leaves with you is governed by Section 11 of the Terms of Service, including its exclusions and its cap. This Section creates no separate indemnity and no duty to defend.

7. Enforcement

If you violate this AUP, we may suspend or terminate your access to Autopage, in whole or in part, and may disable, roll back, or remove offending experiments, variants, or content.

As a rule, we will give you notice and a reasonable opportunity to cure before suspending or terminating. We may suspend access immediately and without prior notice only where one or more of the following enumerated grounds applies:

1. the use is unlawful, or falls within a prohibited safety category under Section 3.1;
2. the use poses an imminent risk of harm or legal exposure to us, your visitors, or third parties;
3. the use threatens the security, integrity, or availability of the service or its infrastructure (including the technical abuse described in Section 5);
4. we are required to act by law, by a court, or by a competent authority; or
5. the violation is serious and is repeated after a prior notice to cure.

We will limit any immediate suspension to what is necessary and, where practicable, will notify you promptly afterwards and restore access once the ground for suspension has ceased. Any action under this Section is without prejudice to our other rights and remedies under the Terms of Service and at law.

8. Reporting Abuse

To report a violation of this AUP, or content or activity that you believe breaches it, contact us at support@autopage.dev. To help us act quickly, please include the affected URLs and, where the report concerns email, the full message headers, together with a description of the conduct you are reporting.

9. Changes and Versioning

We may update this AUP. The reasons for which we may do so, the notice we give before a change takes effect, your right to terminate, and the renewed acceptance we obtain for material updates are the ones set out in Section 16 of the Terms of Service, which governs this AUP as well. This Section adds no second mechanism. Each version of this AUP carries a version number and a "Last updated" date, and Finalform records the version and timestamp of your acceptance. Material updates require your renewed acceptance before the updated AUP applies to you; continued use of Autopage counts as acceptance only for non-material updates.
